This Agreement shall begin on the date hereof.

Parts of this website offer users an opportunity to post and exchange opinions and information in certain areas of the website. FeTNA – FiTEN does not filter, edit, publish or review Comments before their presence on the website. Comments do not reflect the views and opinions of FeTNA – FiTEN, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. To the extent permitted by applicable laws, FeTNA – FiTEN shall not be liable for the Comments or any liability, damages, or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.

FeTNA – FiTEN reserves the right to monitor all Comments and remove any Comments that can be considered inappropriate, offensive, or causes breach of these Terms and Conditions.

• You are entitled to post the Comments on our website and have all necessary licenses and consents to do so;

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to FeTNA – FiTEN. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our Website, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.

Approved organizations may hyperlink to our Website as follows:

• By use of our corporate name; or
• By use of the uniform resource locator being linked to; or
• Using any other description of our Website being linked to that makes sense within the context and format of content on the linking party’s site.

No use of FeTNA – FiTEN’s logo or other artwork will be allowed for linking absent a trademark license agreement.

Charges and Billing:

Fees May be Required. fiten.org may require payment of access fees in connection with the Site and Services. Payment processing services for You on fiten.org are provided by our payment processing service provider RazorPay for INR and PayPal for USD payments. These are subject to the RazorPay and PayPal Connected Account Agreement, which includes the RazorPay Terms of Service (https://razorpay.com/terms/) and PayPal Terms of Service (https://www.paypal.com/us/legalhub/home). By agreeing to these Terms of Use or continuing to operate as a User on fiten.org, You agree to be bound by the Payment processing service providers Agreement, as the same may be modified by RazorPay and PayPal from time to time. As a condition of fiten.org enabling payment processing services through RazorPay or PayPal, You agree to provide fiten.org accurate and complete information about You and Your business, and You authorize fiten.org to share it and transaction information related to Your use of the payment processingservices provided by RazorPay or PayPal. All fees shall be paid in INR for Registrations from India and in U.S. dollars for Registrations from US and other countries other than India.

Changes in Fees. fiten.org reserves the right to change any fees (which includes but is not limited to, charging a fee for packages, options, upgrades and/or a Service for which fiten.org does not currently charge a fee) or billing methods at any time, provided, however, that such modifications shall not have a retroactive effect and only impact future charges. fiten.org also has the right to collect applicable taxes and impose premium surcharges for some areas of the Service and these surcharges may apply immediately after You register for the associated service. You may cancel Your account or any associated optional or upgraded services therefore at any time, but fiten.org will not refund your pre-paid fees in INR or USD should you decide not to participate at FiTEN event.

Payment. You agree to pay the Event Registration cost in full and You also agree to pay any taxes, including sales or use taxes, resulting from Your Transaction or use of the Service.

Third Party Sellers. Parties other than fiten.org provide services, or sell products or access to their Events on the Site. You may order services or merchandise through the Site from other persons not affiliated with fiten.org (“Seller”). All matters concerning the merchandise and services desired from a Seller, including but not limited to purchase terms, payment terms, warranties, guarantees, maintenance and delivery, are solely between You and Seller. fiten.org makes no warranties or representations whatsoever with regard to any goods or services provided by Sellers. You will not consider fiten.org, nor will fiten.org be construed as, a party to such transactions, whether or not fiten.org may have received some form of revenue or other remuneration in connection with the transaction. You agree that fiten.org will not be liable for any costs or damages arising out of such transactions, either directly or indirectly. We are not responsible for examining or evaluating, and we do not warrant the offerings of any of these businesses or individuals. fiten.org does not assume any responsibility or liability for the actions, product or content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use. It is the responsibility of the Event organizer to communicate its refund policy to You and to issue refunds to You via the Site or otherwise. You understand and agree that Event organizers reserve the right to cancel Events for various reasons, including, without limitation, in the event of weather events (including, but not limited to, heat, tornadoes, earthquakes, fires, storms, lightning and floods), accidents, any pandemics, acts of war or terrorism, military conflicts or riots or for any reason that would affect the safety and security of Event participants and spectators. In the event of such cancellation, there will be no refund of Your payment. You may report the misconduct of Event organizers and/or third parties in connection with the Site or any Services to us, and we, in our sole discretion, may investigate the claim and take action.

Given fiten.org is a self-service and open platform, fiten.org does not represent and/or warrant the accuracy nor the legality of the events posted on its site. However, fiten.org does not tolerate and/or endorse any event that may involve illegal activity and/or violates public policy. The definition of “illegal activity,” and/or “public policy,” is at the sole discretion of the Company and You agree to such discretion. Accordingly, fiten.org is not responsible and/or liable for any events that may fall under these categories. Moreover, if such illegal activity is found and/or reported, fiten.org will make every effort to remove such an event from its site. However, You acknowledge fiten.org is not responsible
for any third party seller’s representation and/or their event. Further, fiten.org will be wholly indemnified pursuant to Paragraph 20 of our Terms below if any claim that may arise from third parties.

Donations:

When You make a donation, fiten.org receives a fee for the use of our technology without any additional charge to You. Donations collected by fiten.org will be sent in regular intervals to the designated charitable organization in accordance with contract and applicable law, less fiten.org’s fee. Any refunds shall be exclusively and directly handled by the designated charitable organization. fiten.org shall not be responsible for processing or making any refunds.

Content Liability:

We shall not be held responsible for any content that appears on your Website. You agree to protect and defend us against all claims that are raised on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene, or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Reservation of Rights:

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.

Removal of links from our website:

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us at any moment. We will consider requests to remove links, but we are not obligated to or so or to respond to you directly.

We do not ensure that the information on this website is correct. We do not warrant its completeness or accuracy, nor do we promise to ensure that the website remains available or that the material on the website is kept up to date.
